My name is Phyllis Carter. I am a Canadian and I am a crime victim. I have been fighting for justice since October 7, 1996, when I was attacked in my home and robbed of everything I had worked for all my life and everything left to me by my beloved husband. I told the police immediately who had robbed me, but a Montreal Police officer helped the thieves and, since then, the police have refused again and again to act in this case.
At the Meet the Candidates assembly in NDG on October 7, 2008, Liberal Member of Parliament, Marlene Jennings, stated before all the candidates and the public, "Mrs. Carter's rights were violated three times".
The three violations.
1. In 1996, the Montreal Police refused to file a report of the initial robbery. They have continued to refuse to act ever since.
2. In 2007, immediately following the death of my mother, the same group of criminals obtained a court order accusing me of being insane and dangerous. I was released from hospital unconditionally as soon as the doctors found out what my accusers had done and why. After my mother's death, we learned that -
3. In 2005, the same group who call themselves "Partners in Crime" created a will in my mother's name when she was 92 years old and handicapped physically and mentally. My mother was kept in total isolation by these criminals for ten years - until her death. The sole beneficiaries of the 2005 will were the same people who robbed me and obtained the court order against me. Then it became clear why these criminals tried to discredit me and silence me.
Marlene Jennings was re-elected to Parliament on October 14, 2008. I am still waiting for Mrs. Jennings to take the appropriate actions in this case.

PARTNERS IN CRIME: A MATTER OF PUBLIC RECORD
On October 7, 1996, I was attacked and robbed in my parents' Montreal home, where I had been living for two years while recovering from breast cancer. At the beginning of October my teenage niece, Dawn McSweeney, and her boyfriend Alex had moved in with us. Within a week of Dawn's arrival, I was suddenly attacked for no apparent reason and without any warning. In shock, I managed to call 911.
One of the two officers who responded to my distress call 'helped' me out the door without as much as a coat. In front of my assailant, the officer told me that I must never return. This police officer's unilateral decision to evict me, forbidding me to return home, gave all my most precious belongings, and my aged parents' lives and property into the hands of Dawn McSweeney.
This action was taken without any investigation. There was no legal procedure. No hearing. No court procedure. No trial. No judgment. No background to support such an action. No justification. The officer just decided to do it. And then - he did not file a report.
Widowed, unemployed and fighting cancer, the Montreal Police abandoned me in the street alone, cold, homeless and destitute. My entire life was locked up behind me, in the hands of my teenage niece, Dawn McSweeney. I pleaded with the police to file a report, to go to the house and see for themselves the proof of what I was saying. They refused again and again. For six months, the police refused repeatedly to file a report. At 60, I had to start life again - from scratch.
Quebec's Police Ethics Commissioner, Denis Racicot, wrote to me: "The police have large powers and vast authority .... The case is "definitively closed." Large powers - to help criminals? Vast authority - to rob widows ?
I appealed to Quebec Premier Jean Charest. He wrote to say that the theft of all my jewellery and the fruit of my life's work and the personal treasures my husband left to me, is "a civil matter of an unfortunate nature." Grand larceny is a civil matter ?
After the robbery, Dawn's mother, Debbie McSweeney, our youngest sister, obtained power of attorney from both my parents. Every other member of the family, social services, fire protection inspectors and even police detectives, were barred from my parents' home thereafter.
In April, 2004, the home of our youth looked like something out of an Alfred Hitchcock movie, doors and windows overgrown with dead vines. I called for help and learned that my mother had been removed from her home. So I went to the police station to file a missing person report. The officer could not file a report - because Debbie, told him by telephone that she knew where mother was. To see your mother or get information about where or how she is, you have to file a civil suit. "But you will need a lawyer. " But that would take months ! Can't the police check on my mother now ? Sorry.

In June, 2007, we learned that our mother had died. She was buried on June 21, 2007 after being kept in total seclusion by Debbie and her associates from the day of the robbery. Suddenly, on June 26, I started receiving hate mail and threats to drop the robbery case were posted on my blog. I reported that to the police immediately. The next afternoon, June 27, two police officers came to my door with a court order to have me committed for a 30-day mental evaluation, accusing me of being insane and dangerous. I was released from the hospital unconditionally on June 29, 2007.
The Suburban newspaper carried that story in two parts,
on September 5, 2007 and on September 12, 2007.
The following is also a matter of Public Record.
Weeks later, I found out why a complete stranger wanted me silenced: My accuser, the mise en cause who applied for the court order, was one Kenneth Gregoire Prud'homme, a person I do not know and with whom I have never spoken. This same Prud'homme is named as the liquidator of a will in my mother's name created when she was 92 years old, handicapped mentally and physically and had been totally under the physical control and influence of Debbie and this group for a decade. Their will was notarized and executed, but OUR MOTHER DID NOT SIGN THAT WILL. All the children were included in the wills my parents had made. Only Debbie and Dawn McSweeney and Kenneth Gregoire Prud'homme benefit from the bizarre 2005 will.
Months later, I discovered Dawn McSweeney's own blog on the internet. The heading reads:
Dedicated to partners in crime and kindred spirits. Voyeurs and well wishers also welcome.

In November, 2007, my Member of the Quebec National Assembly wrote an appeal to the Conseil de la Magistrature against the judge who condemned me with his court order in less than four minutes without ever seeing me or speaking to me and without any medical evidence, but based solely on the bizarre accusations made by a man I do not know and Debbie who had not spoken with me since 1997. The Conseil de la Magistrature of Quebec replied that the judge did nothing wrong.
I am now 73 years old. I have been fighting for justice in this case for thirteen years. I will never give up. I want to make it very clear that I will not accept money or "compensation" from anyone. I want my parents' true wills to be reinstated. I do not want anything from my parents' estate for myself. I want only what Dawn McSweeney and her associates stole from me. And I want the thieves tried in criminal court.
I am fighting for that rare and elusive treasure - JUSTICE !
I will not settle for anything less.

So I went to the police station to file a missing person report. The officer could not file a report - because Debbie, told him by telephone that she knew where mother was. To see your mother or get information about where or how she is, you have to file a civil suit. "But you will need a lawyer.
" But that would take months ! Can't the police check on my mother now ? Sorry.

In June, 2007, we learned that our mother had died. She was buried on June 21, 2007 after being kept in total seclusion by Debbie and her associates from the day of the robbery.

Suddenly, on June 26, I started receiving hate mail and threats to drop the robbery case were posted on my blog. I reported that to the police immediately.
The next afternoon, June 27, two police officers came to my door with a court order to have me committed for a 30-day mental evaluation, accusing me of being insane and dangerous. I was released from the hospital unconditionally on June 29, 2007.

This same Prud'homme is named as the liquidator of a will in my mother's name created when she was 92 years old, handicapped mentally and physically and had been totally under the physical control and influence of Debbie and this group for a decade.
Their will was notarized and executed, but OUR MOTHER DID NOT SIGN THAT WILL. All the children were included in the wills my parents had made. Only Debbie and Dawn McSweeney and Kenneth Gregoire Prud'homme benefit from the bizarre 2005 will.

In November, 2007, my Member of the Quebec National Assembly wrote an appeal to the Conseil de la Magistrature against the judge who condemned me with his court order in less than four minutes without ever seeing me or speaking to me and without any medical evidence, but based solely on the bizarre accusations made by a man I do not know and Debbie who had not spoken with me since 1997. The Conseil de la Magistrature of Quebec replied that the judge did nothing wrong.
I am now 73 years old. I have been fighting for justice in this case for thirteen years. I will never give up. I want to make it very clear that I will not accept money or "compensation" from anyone. I want my parents' true wills to be reinstated. I do not want anything from my parents' estate for myself. I want only what Dawn McSweeney and her associates stole from me. And I want the thieves tried in criminal court.
I am fighting for that rare and elusive treasure - JUSTICE !
I will not settle for anything less.

Read about How We Might Die In Hospital: How a well-respected emergency room physician at the Jewish General Hospital in Montreal sent me home to die. At this writing, the case of Dr. Jerome Stasiak is under review but, to date, I have heard nothing but excuses. I will not let this be covered up. If I had obeyed Dr. Stasiak's orders, I would not be writing this. I would have died in April, 2009.

I just received a phone call from Martine Caouette of "Protecteur de Citoyen du Quebec." (See blog for details)
She told me that this case is not in their jurisdiction.
Ms. Caouette told me to go back to the Ombudsman of the Jewish General Hospital.
She told me to go to the College des medecins de Quebec.
She told me to get a lawyer.
In a nutshell, my life is in nobody's jurisdiction.
It would have been so much easier for everyone if I had obeyed Dr. Jerome Stasiak and died.

To The Quebec Human Rights Commission
I am 73 years old and a cancer patient struggling for my life and for justice. I am trying to file a formal complaint against a physician who denied me the right to live.
I am running into red tape and the classical run-around with the Quebec Human Rights Commission.
I sent you an email (see below) asking for the necessary application papers to file a complaint. I was told to download from your website. I can't do that.
I phoned. The person I spoke to this morning suggested that my case may not be eligible for consideration by the Quebec Human Rights Commission.
If I had obeyed the doctor who ordered me to go home, on April 1, 2009 I would be dead. (See my report below).

She said that it is clear that my human rights were violated, but my case is not in the jurisdiction of the Quebec Human rights Commissions' because their mandate does not apply unless I can prove that the doctor discriminated against me.
I asked her in whose jurisdiction this is. She suggested I get a lawyer. I have no money for a lawyer. She referred me to the College des Medecins du Quebec who have already told me that the Jewish General Hospital should investigate itself. The Jewish General Hospital has already told me that Dr. Stasiak is sorry and he apologizes. Case closed.
Rosemary Steinberg, Ombudsperson for the Jewish General Hospital has referred the case to Dr. Fred Lowy for review, but based on everything I have experienced so far, I expect the cover-up will continue.
Ms. Laurin then referred me to Protecteur de Citoyen de Quebec at 514-873-2030. I will try. It is survival of the most stubborn. The weak just die and are silenced forever. I am very weak but I am not dead yet.
But the only real solution in an unjust society is to die. There must be someone "up there" in whose jurisdiction my case will fall.

Sir,
I have written to you about this matter in the past and received only an automated response. This is a serious matter and I am asking you to take it seriously.
It has been eight months since my life was put in jeopardy by Dr. Jerome Stasiak in the emergency department at the Jewish General Hospital in Montreal.
Chief of Staff, Dr. Joseph Portnoy's response to this abuse is totally unacceptable and the College des medecins du Quebec persists in telling me to let the Jewish General Hospital investigate itself.
Clearly, the hospital has no intention of taking any action and is trying to bury this case. While I am still alive, I will not allow this abuse to stand.
What do you intend to do about it?

CALL ME JEREMIAH !
We can't believe anything we see or hear anymore. Centuries ago, there was a man named Jeremiah, a prophet who warned of great disasters to come. He was considered mad. Maybe he was. But he was right. With modern technology coinciding with a crash in human values on a vast scale, has anyone noticed, we are in really big trouble ? We are on the edge.
While so many people on earth struggle for fresh drinking water and poor children still die of curable diseases, the people who control the world's finances and governments invest billions of dollars in the exploration of distant planets and experiment with ever-more-ominous particle accelerators beneath this very earth - the only planet on which we are able to live.
While hungry families seek affordable housing, CEO's and their government friends bask on tropical beaches with their assortment of prostitutes, and no longer does the general public find it offensive. It is out in the open in the media every day. Anyone who dares to question is quickly tagged a religious fanatic, a relic of ancient days.
It is the Twenty-First Century. The general character of human beings has not changed. It is in our nature to fight to survive. But this nature has gone berserk. People want more and more, bigger and bigger, faster and faster. We are on a roller-coaster that is close to being out of our control.
With the advances in science and technology, it is now possible for those who hold power to commit greater and greater atrocities against life itself. And with the moment to moment acceleration in technology, the dangers are growing exponentially.
We can not believe anything we see or hear anymore. With modern technology, anything pertaining to our senses may be convincingly reproduced or represented. Lies are the norm today. Just turn on your television and watch the commercials and the politicians.
Justice is available only to those who can afford to pay for it.
One does not have to be a follower of any religion to see the truth. It is blatantly obvious to any rational person who chooses to take an interest.
We are in big trouble, but - who cares ?

SURVIVAL OF THE MOST STUBBORN
It is after 4:00 AM on Saturday, January 9, 2010 as I begin this piece.
I am discovering that it is not really "survival of the fittest" that explains why I am still fighting for justice at the age of 73. It is survival of the most stubborn.
I have been struck down by crime and disease and injustice and losses too many to describe here, but somehow I am still up and fighting for justice through the night.
Why ?
Because the more I see cruelty, corruption, neglect, despair, greed and suffering, the angrier I become. My enemies - and I have just a few I think - who might still be foolish enough to think that, when they try to hurt me, they weaken me, have made a terrible error in judgement. Their crimes and cruelty have strengthened me as I was never strong before.
Looking back, I see that I have been fighting injustice since I was in elementary school - the proverbial but true - bringing home stray puppies, birds with injured wings, the boy that the popular girl insulted. I have always been hurt by the suffering of others and I have always done something to try to make it better.
My picture seen at the top of this piece is from the cover of my book entitled,
A PORTRAIT OF ASGAR AND THE PLIGHT OF KASHMIR. This is the true story of a brilliant but very modest son of Kashmir who sought me out in the mid-1960's after reading many of my Letters to the Editors in the Montreal Star and The Gazette. I was moved to tell his story of the tragedy that has hung over that beautiful land for generations. I wrote a book - a little book, but one jammed with history, facts, and feelings. I did something.

Most of all, know this: Silence implies consent, and truth is the most powerful weapon on earth and, I expect, in the universe. Tyrants - major and minor - fear truth more than anything, even when it is spoken or written by the weakest among us.
I am fighting bone cancer and I am fighting powers and principalities and yes, I am fighting evil. I am fighting wrong and fear and coldness and corrupt systems and people who have authority but no sense of individual responsibility or care for others.
But, note, I am fighting - because, somehow I have been graced with a gift that drove my parents to distraction - stubbornness. I thank God for my stubbornness.
